Criminal Division
The Criminal Division is responsible for handling all felony cases, appeals of Bernalillo County Metropolitan Court criminal cases, extraditions of felons in other jurisdictions and requests for search warrants. Other cases handled by this division involve pre-prosecution cases, Adult Drug Court matters and the disposition of evidence. The Criminal Clerk’s Office is responsible for maintaining the official Court record for criminal cases. All criminal case documents are processed by this office.
Civil Division
Civil Court cases involve disputes between individuals, businesses, or state or local government. These disputes can involve automobiles or other accidents, personal injury or property damage, medical malpractice, breach of contract, landlord tenant relations, real estate or other property rights, student loans, taxes and violations of, or objections to, state or local ordinances or other regulations, or appeals from Bernalillo County Metropolitan Court cases. The Civil Clerk’s Office is responsible for processing all new complaints or petitions, responses and any subsequent motions that are filed in these cases, as well as for collecting related fees.
Domestic
The Domestic Relations Division (DR) is responsible for filing into and managing the Court records for Family Court cases, which include Divorce/Dissolution of Marriage, Legal Separation, Annulment, Parentage/Custody, Kinship Guardianship of a Minor Child, Child Support and Domestic Violence/Restraining Orders.
Children's Court
Children’s Court handles matters pertaining to youth under the age of 18 in the following areas: adoption (child only), child abuse and neglect, delinquency, emancipation, marriage authorization, mental health commitments (adult and child), sealing of juvenile records, and youthful offender cases.
Special Services
The Special Services Division stores case exhibits and takes requests for recordings of hearings and trials for the grand jury, domestic relations, domestic violence, mental health, and children’s court matters, as well as handling appeals by preparing and sending the Record Proper along with Designations of Transcripts and Exhibits to the appellate courts.
