The Court Clinic has been providing services in the Second Judicial District Court for 30 years.
Theresa Miller, Ph.D., is the Court Clinic Director, which is staffed by licensed mental health professionals that conduct court ordered services ranging from mediation to advisory consulation. The services assist parents and the Court in determining custody and timesharing in the best interests of children.
Court Clinic services are available only by court order. Parties may request mediation services by completing a Court Clinic Referral Order (CCRO) and submitting it to their judge for approval.
Court Clinic services are free except for Advisory Consultations. Advisory Consultations are subject to a fee on a sliding scale.
Pursuant to NMSA 1978 §40-12-3(F), "Mediation" means a confidential process in which parties meet with a Clinician in order to assist the parties in focusing on the needs of the children and to assist in reaching a mutually acceptable parenting plan regarding the children.
Consultations provided to the Court whenever the Court requires this service. This service is either immediate assistance by a clinician or the Court refers the parties to a scheduled on-call where an appointment is set with the parties, relevant caregivers and the children to provide suggestions directed to the best interests of the children.
- Priority Consultations: Pursuant to NMSA §40-12-3(C), "Priority Consultation" ("PC") means the Court has requested specific information and has approved an immediate and brief assessment regarding the parenting situation and suggestions regarding temporary arrangements.
- Advisory Consultations: Pursuant to NMSA §40-12-3(A), "Advisory Consulation" ("AC") means a brief assessment about the parenting situation and a written report summarizing the information for the parties, the attorneys and the Court, including an assessment by a Clinician of the positions, situation and relationships of family members and suggestions regarding specific plans, general issues or requested action.
